Tax Attorney - IRS Audit Defense

We are seeking a skilled and experienced mid-level tax attorney to join our team and focus primarily on handling audit responses to the IRS for contested claims related to the Employee Retention Tax Credit (ERTC).

In this role, you will play a critical part in advising and representing clients throughout the audit process, ensuring compliance with tax laws and regulations, and advocating for the best possible outcomes.

Responsibilities:

Provide expert legal advice and guidance to clients on matters pertaining to the Employee Retention Tax Credit (ERTC) and related tax laws and regulations.

Review and analyze documentation, financial records, and other relevant information to prepare comprehensive responses to IRS audit inquiries regarding ERTC claims.

Collaborate with clients and internal teams to gather necessary information and evidence to support the defense of contested ERTC claims during IRS audits.

Draft clear, concise, and persuasive written responses to IRS audit notices, including legal arguments, explanations, and supporting documentation.

Communicate and negotiate with IRS agents or representatives on behalf of clients to resolve audit issues and disputes related to ERTC eligibility and compliance.

Conduct legal research to stay informed about updates to tax laws, regulations, and IRS guidance related to the ERTC, and incorporate findings into audit defense strategies.

Assist clients in implementing corrective actions or adjustments to ERTC claims as needed to address audit findings and ensure compliance with IRS requirements.

Advise clients on best practices for record-keeping, documentation, and compliance measures to minimize the risk of future IRS audits or challenges related to the ERTC.

Stay current with industry trends and developments in tax law, particularly as they relate to the ERTC, and provide training or guidance to colleagues as necessary.

Requirements:

Juris Doctor (J.D.) degree from an accredited law school and active membership in good standing with the state bar association.

Minimum of 3-5 years of experience practicing tax law, with a focus on representing clients in IRS audits and disputes related to tax credits, incentives, or similar programs.

Demonstrated expertise in the Employee Retention Tax Credit (ERTC) and comprehensive understanding of relevant tax laws, regulations, and IRS procedures.

Proven track record of successfully managing complex tax matters and representing clients in negotiations with government agencies or regulatory authorities.

Strong analytical skills and attention to detail, with the ability to review and interpret financial data, legal documents, and regulatory guidance accurately.

Excellent written and verbal communication skills, including the ability to articulate complex legal concepts clearly and persuasively in written audit responses and oral presentations.

Ability to work independently, prioritize tasks, and manage multiple projects simultaneously while adhering to strict deadlines and client expectations.

Collaborative mindset and willingness to work closely with clients, colleagues, and other stakeholders to achieve favorable outcomes in IRS audits and disputes.

Proficiency in legal research tools, tax software, and Microsoft Office suite.
