Supplemental InformationThe Louisiana Department of Revenue (LDR) is responsible for fairly and efficiently collecting state tax revenues to fund public services, to regulate charitable gaming and the sale of alcoholic beverage and tobacco, and to support state agencies in the collection of overdue debts. Collectively, each program, unit, division and group work together to provide the core services to taxpayers of the State of Louisiana and stakeholders of the agency. LDR is comprised of the following groups: Tax Collection, Charitable Gaming, Alcohol and Tobacco Control (ATC), Debt Recovery and Louisiana Tax Free Shopping Commission.The Office of Alcohol & Tobacco Control (ATC) is responsible for overseeing the alcoholic and tobacco industries within the state. The office is comprised of four divisions: Administrative, Business, Legal and Enforcement.The Legal Unit includes litigation, mediation, formal settlement negotiations, participation in administrative hearings, regulatory oversight and policy planning and advisement. Types of litigation may include, but are not limited to: appeals of administrative decisions, injunctive relief and declaratory judgments. In addition, legal counsel exercises general overview of the Tobacco licensing and regulatory functions conducted by the Business and Enforcement Divisions. Duties include, but are not limited to:

Responsible for tax hearings and tobacco cash/credit hearings. Reviews and prosecutes applicant suitability issues.

Prosecutes administrative violations of ATC laws. Oversees the preparation of formal written hearing decisions setting forth findings of fact, the applicable law, and reasons for the decision.

May represent the agency in litigation such as precedent cases before trial and appellate courts and administrative tribunals by drafting pleadings, interviewing witnesses, writing legal memoranda and briefs. Acts as liaison with other in-house counsel and outside counsel d u ring these litigations.

Receives and evaluates complaints, reports, citations, and evidence from law enforcement officials relative to alleged violations of Alcohol and Tobacco Control laws and determines whether prosecution is appropriate.

Confers with law enforcement officials and requests follow-up investigation of licensed facilities when preliminary reports have established cause for further investigation.

Supervises and manages staff to ensure that all functions are performed within the established work standards.

Responsible for managing the activities associated with hiring and developing subordinate staff appropriately , including annual performance evaluations

Develops and conducts tobacco awareness and education programs at schools and other public venues.

Drafts tobacco related press releases and Informational materials as needed.
