Yes County Albany Street Address 161 Delaware Avenue City Delmar State NY Zip Code 12054 Minimum Qualifications Suitable candidates must possess the following qualifications: At least ten (10) years of experience as an attorney, at least two (2) of which involve supervising other attorneys; Civil litigation experience, including participating in trials and/or evidentiary hearings preferred; Superb legal analysis, legal writing and editing, and oral advocacy skills; Excellent project management, organizational, interpersonal communication, problem solving, and teamwork skills; Strong technological skills, including knowledge of and experience with various computer software programs and electronic discovery platforms; Prior government, legislative, non-profit and/or public policy experience is preferred.Applicants must reside in (or intend to soon become a resident of) New York State and be admitted to practice law in New York State. In addition, the Public Officers Law requires that attorneys in the Agency be citizens of the United States. Duties Description The Deputy Counsel reports to the General Counsel and provides technical legal assistance and advice to the General Counsel and other executive staff. The incumbent assists in the management and conduct of litigation and the provision of guidance and legal counsel to executives and program managers on a wide range of issues confronted by the NYS Justice Center for the Protection of People with Special Needs (Justice Center), a reform agency committed to supporting and protecting health, safety and dignity of all people with special needs. The incumbent interprets laws applicable to the Justice Center and consults with executive staff regarding new legislation and changes in existing laws. Advice and legal opinions are rendered concerning all programs within the Justice Center. The incumbent ensures coordination of legal requirements with the activities of state and local agencies, as well as with the private, voluntary and/or non-for-profit entities. Specific duties will include, but are not limited to, the following:1. Manage portfolio of litigation, involving defense of state agency in lawsuits in state and federal court. Conduct legal research, develop strategies for use in the preparation of briefs and presenting oral argument at judicial proceedings. 2. Request and facilitate representation of the agency by the Attorney General’s Office, where appropriate and assist in development of strategies in marshalling and presenting evidence and preparing legal memoranda in support of the agency.3. Prepare and present legal cases for which there is little precedent or may have a major impact on the Justice Center. 4. Develop, review and recommend to the General Counsel changes to existing legislation; recommend the creation of new statutes, rules and/or policies in the furtherance of the agency’s goals and objectives.5. Implement new legal initiatives or modifies existing legal programs as necessary in order to carry out pertinent aspects of the Justice Center’s specific mission.6. Draft regulations, rules, legal documents and agreements necessary for the operation of the Justice Center and coordinated efforts among affected agencies.7. Analyze legal issues, prepare briefs, search statutes, decisions, opinions and other sources for use in the preparation of briefs and presenting oral argument at judicial proceedings.8. Conduct research and analysis on policy positions of the Justice Center, which may include research on legislation, declaratory rulings, opinions and other assorted and diverse matters.9. Serve on the Risk Council, which is responsible for oversight of the agency’s enterprise risk management process.10. Discuss proposed and new legislation, court decisions and administrative decrees that affect the Justice Center’s operations with agency policy makers and provides legal advice and counsel as the potential impact or required changes to existing policies and procedures.
