Description We are partnering with an AV-rated law firm in the East Bay, specializing in employment, business, and real estate litigation, to source an Employment Litigation Attorney to join their team on a temporary basis. In this role, you will support the firm’s employment and business litigation caseload, managing various aspects of litigation including discovery, motion drafting, and case strategy development. The ideal candidate will have experience in California-based employment litigation, handling matters such as wage and hour disputes, wrongful termination, discrimination, harassment, retaliation, and PAGA claims. Attorneys with business litigation experience are also encouraged to apply, as they can assist with the firm’s commercial litigation caseload, including contract disputes, business torts, and partnership disagreements. The ideal attorney will be able to work on-site in Pleasanton, CA on a flexible hybrid basis, but remote schedules will be considered for the right candidate. Key Responsibilities:

Manage all phases of employment litigation, including case assessment, discovery, and drafting motions.

Handle employment law cases such as wage and hour disputes (including class actions and PAGA claims), wrongful termination, harassment, discrimination, retaliation, and employment contract breaches.

Assist in business litigation cases, including contract disputes, breach of fiduciary duty, partnership disputes, and other commercial litigation matters.

Draft legal documents including complaints, answers, discovery requests and responses, and motions such as motions to compel, demurrers, and summary judgment motions.

Participate in and manage discovery, including drafting and responding to interrogatories, requests for production, requests for admission, and handling electronic discovery (e-discovery).

Conduct and assist in depositions, including preparing outlines and reviewing transcripts.

Assist in preparing settlement agreements and support attorneys in mediation and arbitration.

Provide legal research and analysis related to California employment laws, including FEHA, FMLA, CFRA, ADA, California Labor Code, and business laws as applicable.

Requirements

Requirements:

Minimum of 2 years of California-based employment litigation and/or business litigation experience

Active California Bar License, in good standing

Strong experience managing discovery, including drafting and responding to written discovery (interrogatories, requests for production, and requests for admission), handling e-discovery, and preparing motions to compel

Proficient in drafting and responding to motions, such as motions to compel, demurrers, motions for summary judgment, and motions for protective orders

Experience managing cases through various stages of litigation, including discovery, drafting pleadings, and coordinating with internal teams

Familiarity with California employment laws, including wage and hour disputes, FEHA, PAGA, and wrongful termination cases

Experience handling commercial disputes, contract litigation, and business torts
