This position serves a critical role in collecting, evaluating, and analyzing documents and information to approve job orders and applications submitted from employers, attorneys and/or agents regarding the Foreign Labor Certification (FLC) program. This position is also involved in tracking information of housing inspections for agricultural workers and may conduct on-site field checks. Pay: $42,776.81 – $52,000.00 Annually

Your Specific Responsibilities:

This is a highly responsible position within Foreign Labor Certification of the Employer Support Services unit. The incumbent must be knowledgeable of Foreign Labor Certification guidelines, regulations, policies and rules governing the filing procedures and operation of the program. They must also be knowledgeable of the rules and regulations of the Agricultural Recruitment System, Occupational Safety and Health Administration (OSHA) housing regulations, farmworker rights and prevailing wage and employment practice guidelines.

Coordinates or conducts on-site pre-occupancy housing inspections to ensure that H-2A housing is in compliance with OSHA or the applicable standards. Compiles or requests housing inspection reports, requests migrant labor camp operating permits when appropriate, coordinates with employer/attorney/agents to correct housing deficiencies and provides housing certifications to U.S. Department of Labor (USDOL).

Conducts detailed reviews of H-2A ETA 790 applications and supporting documentation to establish compliance and conformity with federal regulations. Sends notices of acceptance or deficiency to employers, attorneys and/or agents, as appropriate. Corresponds with the United States Department of Labor (USDOL) regarding job orders.

Enters required information in Florida’s labor exchange management information system – Employ Florida. Coordinates positive recruitment efforts through the agricultural clearance order activity with local offices and other state workforce agencies. Provides technical assistance and coordination between parties when there are referral issues.

Provides direction, guidance and technical assistance for the FLC programs and related activities. Communicates and coordinates with local workforce development board staff, employers, attorneys, agents and other interested parties regarding federal regulations for the programs. Responds to related emails and correspondence.

Reviews H-2B job orders to ensure accuracy of information from employers, attorneys and/or agents to establish compliance and conformity with federal regulations. Contacts appropriate parties, if required, for correction, addition or deletion of information regarding job orders. Sends confirmation of opened job orders to requestors. Corresponds with the USDOL regarding job orders.

Participates in conducting prevailing wage and practice surveys used in the H-2A program to collect information on crop activity, prevailing wages and prevailing employment practices. Gathers survey data and confirms information through phone contacts with employers or agents.

Assist the State Monitor Advocate with conducting unannounced field checks on H-2A job orders that have placements of U.S workers made through the clearance system.

Performs other duties as assigned.

Required Knowledge, Skills, and Abilities:

Knowledge of Foreign Labor Certification and Wagner-Peyser guidelines, regulations, policies and rules.

Knowledge of OSHA housing regulations

Knowledge of rules and regulations governing the Agricultural Recruitment System.

Knowledge of the Employment Service and Employment-Related Law Complaint System.

Knowledge of workforce development programs.

Excellent verbal and written communication skills,

Ability to interpret complex state and federal laws, regulations, guidelines, and requirements.

Qualifications:

As a condition of pre-employment eligibility, a Level 2 security background screening is required, which consists of fingerprinting and a check of local, state, and national law enforcement records.

Minimum:

Duties and responsibilities of this position must be performed at the official work site of the Department.

Travel may be required and must provide own transportation.

Preferred :

Experience working with web-based systems.

Experience researching federal and state statutes, regulations and other governing authorities.

Ability to exercise sound judgment and make critical decisions.

Ability to understand and apply applicable rules, policies, and procedures related to eligibility determinations.

Ability to organize data into logical format for presentations, reports, documents, and other written materials.
