Applicants must be eligible to work in the United States at the start of employment.Direct Care and Treatment (DCT) is seeking an individual to join our DCT Legislative Affairs Team for an exciting and rewarding opportunity as a Data Privacy Legal Analyst! This position will lead projects and provide advanced administrative and technical support to the General Counsel’s Office (GCO) by tracking legal issues, by conducting a variety of legal research and analysis assignments, by assisting and/or taking the lead in the preparation of data request and other legal or administrative documents, interpreting Minnesota statutes and administrative rules, and reviewing state and federal regulations affecting DCT in privacy and security matter. This position assists with the development, drafting, auditing, and maintenance of the Department’s data protection, data sharing, and data management initiatives and projects. This position will assist GCO attorneys with data privacy training and the development of policy and legislative efforts by conducting trainings, attending hearings and being the lead of policy review. This position also exists to perform other special projects as assigned.Primary responsibilities include:
Provide assistance with the DCT’s data privacy and data security functions to ensure compliance with state and federal law, including: the Minnesota Government Data Practices Act, the Health Insurance Portability Accountability Act ("HIPAA"), Health Information Technology for Economic and Clinical Health (“HITECH”), and other relevant privacy laws.
Provide assistance to the Department Data Practices Compliance Officer, the HIPAA Compliance Officer, and the 21st Century Cures Act.
Provide legal support and related services to DCT leadership, management, and staff and to DCT divisions as directed by supervisors in the General Counsel’s Office.
Provide legal advice and services related to proposed legislative changes affecting data privacy.
Conduct legal review of DCT data privacy and security policies to ensure consistency with DHS and DCT policies, applicable statutes, rules, regulations, licensing requirements, and regulatory standards.
Develop and conduct trainings on legal policies pertaining to data privacy and security.
Minimum QualificationsThree (3) years of legal or research experience which demonstrates the following:
Experience with the Minnesota Government Data Practices Act, HIPAA, HITECH, and other relevant privacy laws.
Experience with legal research and providing legal support and review.
Experience working with state and federal laws and legal concepts.
Experience communicating and composing correspondence and reports to communicate effectively with coworkers, leadership, management, and staff.
Note: A bachelor’s degree in legal studies, or related field may substitute for 1 year of experience OR master’s degree in legal studies, or related field may substitute for 2 years of experience OR Juris Doctor from accredited law school may substitute for 2 years of experience.Preferred Qualifications
Public sector experience.
Strong analytical and problem-solving skills.
Strong organizational and time management skills to handle multiple tasks simultaneously.
Proficiency in using Microsoft products such as Word, Excel, and PowerPoint.
Juris Doctor from accredited law school.
