my evil (lawyer) sister sued 5 years ago to have my mom declared incompetent (due to early dementia) so she could break her will (my mom had cut her out of her will years before without my knowledge) and then had the court appoint a guardian, and had her involuntarily committed
i have since learned the hard way that unless the guardian is grossly negligent, the judge who appointed her is not going to remove her. in the last 3.5 years or guardianship/involuntary commitment, the not-very-nice lawyer guardian has milked my mom's estate out of about ONE MILLION DOLLARS in fees!:(
from my POV, the guardianship thing is a big racket, because NJ will pay lawyers $100/hr to be guardians for indigent patients, yet let these same lawyers charge $500/hr for guardianship work for rich committed people like my mom. guardianship work is NOT real legal work like preparing briefs or writing up contracts or going to court, it's insane that the judge let her bill $500/hr for things like "reviewing bills". so before she was committed, the lawyer guardian added her bill for $100 to review a $100 bill from a handyman to put in a new thermostat in her house (bc she bills in 1/4 hour increments, so that review took her 1 minute but she was able to milk $100 in legal fees)
because i KNOW from experience (and wasting a LOT of on legal fees) that it is almost IMPOSSIBLE to get the judge to rein in the fees of the guardian, or change guardians, or force the guardian to revoke her determination that i need "supervision" when visiting my mom (for which my mom is charged $100/hr), i want to hire a CHEAP lawyer who passed the bar in NJ, to ATTEMPT to do the following, kind of for "symbolic" value:
1. ask the judge to reduce the guardian's hourly rate
2. ask the judge to remove my requirement for "supervision"
3. document all the horrible things done by my sister in a way that it becomes part of the public record, so is free from the strictures prohibiting me from making any "derogatory statements" about my sister (this may require filing a response to their defamation suit in NY, which they paused so is inactive, because i THINK guardianship stuff can be sealed by the judge for "privacy" but a general court case in NY regarding defamation CANNOT BE SEALED
if you have ever watched the film "I care a lot" and want to help FIGHT GUARDIANSHIP ABUSE, maybe you will take on this case for a reduced fee, because of altruistic reasons
to be clear, i am really looking to pay something like $50/hr, for a MAXIMUM of $1000 TO GET ALL 3 THINGS ACCOMPLISHED, but i can pay in CASH (bills) if that's better for you, but you can be ONE DAY PAST PASSING THE BAR!:)
