We are working on a criminal appeal in Houston, Texas.
The evidence of fraud by the District Attorney is apparent but it was not RAISED by the (Trial attorney) so the Appellate court determined it was NOT reviewable on Appeal.
Although I stated that it was (NOT) DISCOVERABLE at the TIME of TRIAL, the Appellate Court ignored the one case cited directly on point.
We are trying to make this argument to the Texas Criminal Court of Appeals which is the Supreme Court in Texas for Criminal Cases.
