TRUST-ESTATE Attorney-Passed NJ Bar (Essex County Surrogate Court)
Trust beneficiary of a Major National Trust Company with Billions AUM and thousands of trust beneficiaries is preparing to file Motion for BREACH OF FIDUCIARY DUTY engaging in due diligence.
Trustee has:
Violated terms of trust/will
Failed to properly obtain required information for Investment Policy Statement
Failed to disclose information on legal expenses charged to trust
Invested in “High” risk assets against wishes of beneficiary
Not taken beneficiary tax bracket into consideration when making fixed income investment decisions
Intimidated beneficiary after questing trustee decisions and rational.
I tried reaching out to established attorney’s through online legal matching services. When I asked questions, I was met with obfuscation and deflection then quickly asked for huge retainers to start work. So now I am taking a different path in my preparation:
If my darkest suspicions are correct, there is the potential for a major class action lawsuit against trustee (If they treat me this way are they doing the same to other beneficiaries?). But I need to complete my due diligence first.
REQUIREMENTS:
Passed NJ Bar
Experience with ESSEX COUNTY Surrogate Court
Ability to do research for cases on point
Familiar with the CFA program-Code of Ethics (III (A) -1 Suitability and Investment Policy Statements
Once I have completed my “pregame” plan I see 100+ hours of legal services for this situation as well as issues I have with the executor which is beyond the current scope of this situation.
MY BACKGROUND:
I am not the traditional trust beneficiary: The executor (my sibling) had my mother’s will changed less than a year before her passing behind my back (Undue Influence) after I informed him, I would take legal action against him for interfering in my financial affairs, resulting in my inheritance going into trust instead of outright (Tortious Interference).
I have a BA Finance and Accounting, and a current CFA Level 2 candidate
I have solid laymen legal experience both as a Plaintiff and Defendant.
Note: I am planning to write a book focusing on the rights of trust beneficiaries based on my situation and experience.
Compensation: $50/hr. (100K per year (annualized)
