Duties Description Accept, record, and process Subpoenas Duces Tecum served upon the Division. Educate Division installations, and subpoena requestors regarding proper service and acceptance of subpoenas.Review subpoenas served at Division Headquarters for legal sufficiency at time of service.Review subpoenas for necessary information, re-contact issuer for additional information if necessary.Identify, locate, and communicate with Division personnel who may be in possession of responsive records. Maintain and assign subpoenas to Attorneys on a rotating basis. Discuss and review responsive records with the assigned attorney. Develop knowledge of those records that Division is not legally required to disclose and recognize and respond to legally insufficient subpoenas.Identify subpoenas that may be legally objectional due to jurisdictional defect, procedural error, and/or substantive grounds, and work with assigned attorney to formulate response strategy.Work with assigned attorney to organize, draft, and prepare motions, affidavits, affirmations, memoranda of law, and other motion-related papers challenging the legal sufficiency of subpoenas.Arrange for the filing of motions and other papers related to subpoena challenges.Review motion responses, identify when replies are necessary, and work with assigned attorney to present legal arguments.Track motion filings and review all court decisions to determine impact on subpoena responses.Prepare final collection of responsive records and correspondence for review and certification by assigned attorney and forward same to court or other interested party within established time frame.Provide daily liaison support with courts, district attorney offices, state and local governmental agencies, law offices and other entities seeking records pursuant to subpoena.Maintain a complete status report and log of subpoenas to ensure timely responses. Maintain all subpoena files electronically. Update and close subpoena files in accordance with mandated deadlines. Maintain Attorney Delegations of Authority ensuring they are kept current. Possess working knowledge of the physical location of specific Division records (Laboratory, Troop Headquarters, Division Headquarters, etc.). Search SJS, RMS, CRMS, TRACS, Niche, IAPro, Evidence.com, EJustice, and other databases for responsive records. Possess working knowledge of various media and their storage capabilities to facilitate the production of voluminous records.Possess working knowledge of computer databases and software such as Adobe Acrobat Professional, Microsoft Word, Outlook, Microsoft Access, Microsoft Excel, SJS, CRMS, TRACS, RMS, and Evidence.com.Assist with general office administration such as answering/directing incoming calls to appropriate personnel. Opening/sorting/directing incoming correspondence to appropriate personnel in a timely manner. Maintaining section supplies and equipment, making sure office equipment is in good working condition, calling for maintenance when necessary. Maintain counsel’s calendar of appointments, meetings, etc.LIBRARY TASKSEnsure that legal library is up to date with the most recent supplements and new volumes.Assist assigned attorney with invoice processing and bill payment for library materials and electronic legal research subscriptions. Place orders for new publications with publishing firms.
